Interior works dispute: KRW 51 million counterclaim rejected
The opponent's counterclaim of about KRW 51 million over the halted works was rejected in full, although our client's own claim of about KRW 20 million was also dismissed.
How the case unfolded
Background
Our client, an interior contractor, stopped work on an apartment renovation and claimed about KRW 20 million for work done. The owner counterclaimed about KRW 51 million for repair costs and loan interest allegedly caused by the delayed move-in.
Issues and ruling
The court found insufficient evidence that the owner's additional costs were actually incurred or fell within our client's scope of work, and held that loan interest could not be claimed separately where the contract contained a liquidated delay penalty. Our client's claim failed for lack of proof of the value of work completed.
Outcome
Both the claim and the counterclaim were dismissed, and the opponent bears the costs arising from the counterclaim.
