Civil Litigation

We act for claimants and defendants in construction disputes such as contract price, defect damages and delay penalties, and in loan, goods payment and guarantee cases.

The bigger the dispute, the more the early plan matters

This practice covers construction disputes, contract price, defect damages, liquidated damages for delay, and general civil matters such as loans, goods payments and guarantee obligations. We have acted both for claimants and in defence.

The larger the amount at stake, the more the outcome turns on deciding early which issues to frame and what material will support them. Whether to apply for expert appraisal, and how far that appraisal should reach, is settled at the same stage.

We also take on appeals where the first instance did not go well. Outcomes vary from case to case.

What we handle: civil & construction

01 Construction Payment Claims

Disputes over payment for work completed, additional or varied works, and reconciliation of advance payments. A recurring issue is whether additional work outside the contract was in fact performed, and if so whether it can be charged. On the employer’s side, the question is usually whether the price can be reduced or set off for defects or delay. This office has acted both in bringing payment claims and in defending them. What can actually be argued depends on what survives, the contract, approvals for design changes, site photographs, work logs. That is the first thing we check at consultation.

02 Defect Damages

Claims against a contractor for the cost of remedying defects, cracking, water ingress, poor finishes, that appear after completion. In multi-unit buildings the claimant is often the residents’ representative body or the individual unit owners. In practice everything turns on the appraisal. Which items are put within its scope, and how the appraiser is appointed, move the recoverable figure substantially. The warranty period also differs item by item, which needs to be sorted out early. This office has acted in defect damages claims brought against contractors. Outcomes depend on the extent of the defects and on what the appraisal finds.

03 Delay Damages

Claims by an employer for liquidated damages once the agreed completion date passes, and the contractor’s defence to them. The dividing line is whether the delay is attributable to the contractor, or to matters outside its control, design changes, permit delays, material supply. Where grounds for extension of time are accepted, the number of days in delay falls and the damages fall with it. The contractual rate and any cap, and the point at which completion is treated as achieved, are argued alongside. Both sides work from the same material, programmes, supervision reports, correspondence from the employer. We start by establishing what still exists.

04 Loans, Goods Payments & Guarantees

Matters where money lent has not been repaid, goods delivered have not been paid for, or a guarantor is called on for someone else’s debt. In loan cases the argument is rarely about whether money moved. It is about whether it was a loan or a gift, and when repayment fell due. Even without a written acknowledgement, transfer records and messages leave room to argue. In guarantee cases the issues are the scope and duration of the guarantee, and whether the creditor gave the guarantor proper notice. This office has acted for defendants facing guarantee claims.

How it works

  1. 1

    Consultation and document review

    Start from what survives

We establish what still exists, the contract, correspondence, transfer records, site photographs, work logs. In larger claims this stage effectively sets the boundary of what can be argued.

  2. 2

    Framing the issues

    Deciding what to contest

We settle which items to claim and which to contest, and fill gaps through requests for fact-finding and document production orders. Where appraisal is needed, its items and scope are designed here.

  3. 3

    Filing or responding

    Where the court process begins

We file the complaint or the defence and take the matter through hearings, responding to the other side and applying for appraisal, witness examination and other steps as needed.

  4. 4

    Judgment, settlement and enforcement

    Through to recovery

The matter concludes by judgment or settlement, and we weigh an appeal where that is in point. Even a win leaves enforcement to be done if the other side does not comply.

Who this is for

Owners harmed by defects or delay

We claim repair costs for defects such as cracks and leaks, and liquidated damages when the agreed completion date is missed.

Unpaid loans or goods payments

We bring claims when a loan has not been repaid or goods delivered have not been paid for.

Those who have been sued

We also defend those who have been sued for construction payments or on a guarantee.

Civil & construction success stories

Summarised from the judgments and decisions with identifying details removed. Every case turns on its own facts.

Defect damages and delay penalties against the contractor won

A construction dispute claiming both defect repair costs and liquidated damages for late completion. Delay damages are recognised only if the contractual completion date, the actual days of delay and responsibility for the delay are proven from the contract and schedule records, so this needed preparation separate from the defect appraisal. The court found in the client's favour. Wonju Branch of the Chuncheon District Court, 2023.

Before you proceed

Start with what records remain

We begin by checking which of the contract, official letters, transfer records, site photos and work logs still exist.

The appraisal scope sets the damages

In defect cases the scope of the expert appraisal decides the damages, so the issues are fixed before applying for it.

Enforcement may follow a win

Even after winning, a separate enforcement procedure is needed if the other side does not pay.
