Claims to split a community group's compensation rejected
Claims of about KRW 48 million to divide compensation held by a residents' group managing a farm reservoir were rejected in full because the group still exists and operates.
How the case unfolded
Background
Our client is a residents' group formed by nearby landowners to build and manage a farm reservoir. After the reservoir site was expropriated and the group received compensation, some members and others claimed that the group no longer had a purpose and demanded about KRW 48 million in distributions and settlement money.
Issues and ruling
The court found that although the land owner had changed, members still farm with the reservoir water and maintain the channels, so there was no ground for dissolution. Some spending, such as on member gatherings, was incidental to legitimate operations and not a distribution of assets, so the condition for the settlement payment was not met.
Outcome
All claims were dismissed, and the claimants bear the costs.
