Claim for vehicle repair costs dismissed again on appeal
In a suit demanding 5.4 million won in vehicle repair costs, the appeal court upheld the first-instance ruling in our clients' favor.
How the case unfolded
Background
Our clients bought a construction vehicle on installments and agreed that the other party would operate it, pay the installments from the earnings, and receive title once the installments were paid off. After running the vehicle for a few months, the other party returned it and then sued, claiming that he had paid 5.4 million won for an engine replacement and that our clients had been unjustly enriched by that amount.
Issues and ruling
The court found that a copy of a receipt was not enough to prove that the repair costs had actually been paid. It added that, even if they had been paid, a comparison of the revenue and expenses during the operating period did not show that our clients had gained any unjust benefit.
Outcome
The claim was dismissed at first instance, and the appeal court dismissed the other party's appeal. The other party bears the costs of the appeal.
