Wonju Personal Rehabilitation: Missed Monthly Repayments, Termination Standards and Supreme Court Precedent

"Will my case be terminated right away if I fall a few months behind?" is one of the questions we hear most often in Wonju personal rehabilitation consultations. Missed monthly repayments are what people going through personal rehabilitation (gaein hoesaeng) worry about most, but missing payments does not necessarily mean your case will be terminated. Based on practical standards and Supreme Court precedent, we have summarized the standards for missed monthly repayments and termination in Wonju personal rehabilitation.

How many months behind before a case is terminated

The standards seen in practice are roughly as follows.

StagePeriod of non-paymentWhat happens
Rehabilitation commissioner's practical guidelines3 months or moreMay be reported to the court
Court operating standardsUsually 6 to 7 months or moreTermination is considered

But there is something more important than the length of time: whether you can pay your monthly repayments going forward.

The legal standard for termination is when performance is clearly impossible

The law does not simply look at whether you missed monthly repayments. It looks at whether it is clear that the repayment plan can no longer be carried out.

  • Failing to pay because you were briefly short of money is not grounds for termination.
  • If you will be unable to keep paying in the future as well, the case may be terminated.

Temporary reasons can be accepted

Looking at Wonju personal rehabilitation consultation cases, the following situations are likely not to lead to termination.

  • Sudden hospital bills
  • Increased spending due to family problems
  • A temporary drop in income

Circumstances like these can be accepted as temporary reasons. However, they must always be accompanied by a plan showing that you can pay your monthly repayments going forward.

You can appeal even after a termination decision

Many people mistakenly believe that everything is over once a termination decision is made. In reality, you can file an appeal and a re-appeal. However, simply pleading your circumstances in words without resolving the unpaid amount will not be accepted.

Restoring the procedure, as seen in a Supreme Court precedent

A recent Supreme Court precedent shows an important standard.

  • The debtor was carrying out a repayment plan to repay KRW 400,000 every month.
  • The debtor missed about a year's worth of monthly repayments, and a termination decision was eventually made.
  • The Supreme Court ruled that the procedure should be revived.

The reasons were as follows. The debtor's child developed a serious illness, the debtor temporarily fell behind because of the treatment costs, and later paid KRW 7 million and settled the rest in full. The Supreme Court found that this debtor was not in a state where repayment was impossible.

There have also been exceptional cases in which a termination decision was cancelled after a future repayment plan was included in an immediate appeal, but such cases are extremely rare.

The three most important things in practice when a payment is missed

  1. Do not leave it unattended. If you take no action while payments are unpaid, the likelihood of termination rises sharply.
  2. Pay even a little. Paying even part of the amount is regarded as showing a willingness to repay.
  3. Submit your reasons together with a plan. You need to show a realistic payment plan, not just an excuse.

How long it takes before termination

The actual flow runs from a missed payment, to observation for a certain period, to a report by the rehabilitation commissioner, to the court's judgment. It sometimes takes from a few months to more than a year, but depending on the panel of judges, a case may be terminated right away, so you should not feel at ease.

Before and after termination are completely different

CategoryBefore terminationAfter termination
PaymentCan respond by paying only partMust pay all unpaid amounts to restore
How to keep the caseCan keep the procedure through an explanationRealistically very difficult

That is why, after termination, many people choose to file again from the beginning rather than seek restoration. Above all, it is important to act before a termination decision is made.

In closing

Missing monthly repayments does not mean termination. A case is terminated when it is clear that you cannot continue repaying. What matters most is your willingness to repay and a realistic plan.

If any of the following applies to you, do not judge on your own; get a Wonju personal rehabilitation consultation. How to respond varies greatly depending on the situation.

  • Your monthly repayments are 3 months or more behind
  • You are about to receive a termination notice
  • A termination decision has already been made
  • You are considering filing again

Personal rehabilitation is a long procedure lasting 3 years or more, so it is natural for unexpected things to happen along the way. What matters is not giving up and responding properly and on time.
