Getting a Credit Card After Personal Rehabilitation or Bankruptcy: Timing and Criteria

The claim that you can never use a card again after rehabilitation is not true. Nor is it accurate to say that a credit card will be issued right after discharge. Personal experiences vary because the principles set by law and the different screening of each card company get mixed together as they are passed around. We have organized everything from how credit information is managed to when credit cards can be issued after personal rehabilitation (gaein hoesaeng) or personal bankruptcy, in the order of the questions we hear most often.

These questions always come up in consultations.

Will I never be able to use a card again after rehabilitation? I heard that after bankruptcy I have to wait five years. Is that right? Someone said they got one after just two years.

Why are cards blocked after rehabilitation or bankruptcy?

A credit card works by spending first and paying later. In effect, a card company is a financial institution that lends a kind of short-term credit. Financial institutions view rehabilitation or bankruptcy as follows.

  • A state in which existing debts could not be properly repaid

  • A history of delinquency
  • A state in which a debt adjustment procedure is in progress
  • A case in which credit risk has actually materialized

All of this information is classified as credit information and shared among financial institutions. Being blocked from using cards is a natural result of the system.

Where is credit information collected?

Domestic financial institutions send information on loans, delinquencies, card use and debt adjustment to Korea Credit Information Services, known in Korean as Hanguk Sinyong Jeongbowon. Korea Credit Information Services collects and manages this information, and banks, card companies and lending businesses look it up to assess creditworthiness.

When rehabilitation or bankruptcy is in progress, information on ongoing debt adjustment, special record information, delinquency records and financial incident information is registered. These records are always checked when a credit card application is screened.

When exactly do cards stop?

It is easy to think that cards are suspended the moment you file for rehabilitation, but in reality there are a few more steps.

When delinquency continues

Being late by a day or two does not immediately block your card. If delinquency continues beyond a certain period, the card company blocks its use.

When you obtain a debt certificate

This is the point to watch most closely in practice. When you obtain a debt certificate from a financial institution while preparing for rehabilitation, that institution becomes aware of the possibility of debt adjustment. This information is shared with Korea Credit Information Services, and some card companies restrict use in advance from this point. This is why it is not unusual for cards to be blocked even before filing with the court.

When can a credit card be issued after personal rehabilitation?

People often say two to three years is enough, but the standard is clearer than that. According to the practice guidelines of the Seoul Bankruptcy Court, once the discharge decision becomes final, that fact is notified to Korea Credit Information Services. Through this notice, the special rehabilitation record information is cleared, the information registered when the repayment plan was confirmed is released, and the risk grade seen by financial institutions when they check is lowered.

So, in principle, the possibility of getting a credit card arises once the discharge becomes final. Please keep in mind that this opens a possibility; it does not mean automatic approval.

Three factors that decide actual issuance

Even when discharge is granted at the same time, credit card results differ from person to person.

  1. Current income: whether you are a regular employee, whether you are enrolled in the four major social insurances, and whether you have worked at one workplace beyond a certain period. Without income, issuance is difficult regardless of rehabilitation.
  2. Credit score: your score has dropped significantly because of the delinquency records accumulated before rehabilitation. Even after discharge, recovering your score takes time.
  3. Financial transaction history: building up sound transactions after discharge, such as repaying small loans on time or using a debit card consistently, helps your score recover.

How is personal bankruptcy different from rehabilitation?

With bankruptcy, the bankruptcy record remains in credit information for some time even after the discharge becomes final. Restrictions on financial transactions usually follow for about five years. This is because with rehabilitation you repaid at least part of the debt, whereas bankruptcy settles debts without repayment, so financial institutions assess the risk more conservatively.

What to check after discharge and tips for applying

Even once the discharge becomes final, not all information is erased automatically. It is good to check in the following order.

  1. Check your credit information with credit bureaus such as KCB and NICE.
  2. See whether delinquency records still remain.
  3. Request deletion if there is any incorrect information.

In practice, records occasionally remain even after discharge.

When applying for a card, the following tendencies appear from experience. Financial companies that were originally your creditors tend not to approve, while card companies with which you had no creditor relationship have a relatively higher chance. The initial limit often starts low, at around KRW 3 million to 5 million. However, each financial company has different internal screening standards, so this is not a fixed formula.

Key points again

  • While rehabilitation is in progress, it is practically difficult to use cards.
  • The possibility of getting a credit card arises once the discharge becomes final and credit information is cleared.
  • With bankruptcy, restrictions usually continue for about five years.
  • Final issuance is decided by income, credit score and financial transaction history.

More important than when you can get a card is building a structure in which you do not fall into delinquency again. Rehabilitation and bankruptcy do not end with reducing debt; they are procedures for putting your finances back on a sound footing, so it is safer to avoid using credit excessively right after discharge. Understanding how credit information works is far more helpful than personal stories on the internet.
