Personal Rehabilitation

A court procedure in which you repay part of your monthly income, after living costs, for three to five years and are discharged from the rest.

Income means options

Personal rehabilitation lets an individual in (or near) insolvency keep their income, pay a court-approved portion of it for three to five years, and be discharged from the remainder. It is available where unsecured debt is under KRW 500 million and secured debt under KRW 1 billion.

Principal can be reduced without creditor consent, and most obligations, including private loans and guarantee debts, fall within the plan. Wage garnishment and forced auction can be suspended. Employees, sole proprietors, freelancers and daily workers can file even without a payment default.

Ahn Hyunhee Law Office registered insolvency as a certified specialty field with the Korean Bar Association in 2021 and has handled rehabilitation and bankruptcy matters in Wonju since.

What we handle: personal rehabilitation

01 Individual Rehabilitation

Individual Rehabilitation is a Korean court procedure that lets a debtor in financial distress restructure debt under the court's supervision. It took effect on 23 September 2004 and is designed to adjust the legal relationships among the debtor and creditors so that the debtor can recover while creditors' interests are still accounted for. A debtor who is insolvent, or at risk of becoming insolvent, repays their monthly income minus living expenses for three to five years. The remaining debt may then be discharged. Unlike General Rehabilitation, the procedure does not require a creditors' vote; it proceeds on the court's confirmation. Ahn Hyunhee has been registered with the Korean Bar Association as a registered specialist in insolvency since 2021. The first consultation covers total debt, whether any of it is secured, and how income is structured, so that the right procedure, Individual Rehabilitation, Personal Bankruptcy, or General Rehabilitation, is identified before anything is filed. Confirmation and the repayment amount are decided by the court case by case, so we set out the eligibility requirements and the likely points of dispute rather than predicting an outcome.

02 Eligibility for Individual Rehabilitation

Individual Rehabilitation is available to a debtor whose total obligations do not exceed KRW 500 million in unsecured debt and KRW 1 billion in secured debt, and who is likely to earn income continuously or repeatedly in the future. If either ceiling is exceeded, General Rehabilitation becomes the procedure to examine instead. The form of that income is not restricted. Employees, sole proprietors, freelancers, part-time workers and daily-wage workers all qualify as long as the income is recurring. Filing is also possible before any payment has been missed, where insolvency is a realistic prospect. In the consultation we first separate secured from unsecured debt to test both ceilings, then review what documents can evidence the continuity of recent income. Because eligibility turns on the records actually filed, we do not declare a case eligible before those records have been checked.

03 Repayment Period and Discharge

The repayment amount under Individual Rehabilitation is calculated from monthly income less living expenses. That surplus is paid in under a repayment plan for three to five years, and once the plan has been carried out in full, the remaining debt may be discharged. Both the amount and the term vary from case to case, depending on income, the number of dependants, and the liquidation value of the debtor's assets. Certain claims set by statute, taxes, fines, child support among them, fall outside discharge, so it is worth establishing which debts will survive the procedure before it starts. We sketch the likely shape of the repayment plan during the consultation, applying the living-expense deduction and liquidation value, and then assess together whether the plan is one the client can realistically complete. Confirmation and discharge remain decisions for the court.

04 Halting Seizure and Collection

Filing for Individual Rehabilitation allows an application for prohibition and suspension orders at the same time. Once granted, individual enforcement by creditors, wage garnishment, deposit attachment, forced auction of real property, stops, and direct collection activity is restrained. An auction to enforce a security interest, however, may proceed even after a rehabilitation plan is confirmed. Where a mortgaged property or a financed vehicle is involved, this has to be checked at the outset; if secured debt makes up the bulk of the case, General Rehabilitation is sometimes the better fit. In the consultation we itemise the enforcement actions currently running and sort them into those that can be stopped and those that cannot. Whether and when an order issues is for the court to decide, so we do not promise timing, we concentrate on assembling the filing materials quickly.

05 Keeping Your Licence and Your Assets

Individual Rehabilitation does not involve an adjudication of bankruptcy. The public-law and private-law disqualifications that follow a bankruptcy adjudication therefore do not apply, and civil servants, teachers, doctors and company officers can go through the procedure while keeping their position and their licence. Assets are not liquidated either. Where bankruptcy converts property into cash for distribution to creditors, Individual Rehabilitation is repaid out of income, so a home and the basis of daily life can be preserved. The liquidation value of what is owned does feed into the calculation of the repayment amount, however, so more assets mean a higher payment. During the consultation we check whether the client holds a position subject to disqualification and how their assets would affect the repayment figure, then compare which procedure carries the smaller cost.

06 Which Debts Can Be Adjusted

Individual Rehabilitation takes in bank loans and credit card balances, but also private loans, money borrowed from acquaintances, and guarantee obligations. A single creditor cannot be left out of the process; every debt the client knows of must appear on the schedule of creditors. Unlike General Rehabilitation, a creditors' vote is not a requirement. Once the court confirms the repayment plan, repayment follows that plan whether or not creditors agreed to it. Some claims fixed by statute nonetheless survive discharge, taxes, fines, and damages arising from wilful tortious conduct among them. We build the schedule of creditors with the client early in the engagement and check it for gaps. An omission there affects the whole procedure later on, which is why it gets the most attention at the start.

How it works

  1. 1

    Consultation and Debt Assessment

    Deciding which procedure fits

We split total debt into secured and unsecured to test the Individual Rehabilitation ceilings, then look at the continuity of income, dependants and assets to arrive at a rough disposable-income figure. Any enforcement or litigation already under way is identified at this stage too. The assessment determines whether the case proceeds as Individual Rehabilitation, Personal Bankruptcy, or General Rehabilitation.

  2. 2

    Preparing Documents and Filing

    Creditor schedule and repayment plan

We gather income records, asset records and the details of each creditor's claim, draft the schedule of creditors and the repayment plan, and file with the court that has jurisdiction. A debt missing from the schedule affects the whole procedure later, so this stage receives the most care. Applications for prohibition and suspension orders are lodged alongside the filing, so that enforcement and collection already in progress can be halted where possible.

  3. 3

    Commencement and Fixing of Claims

    Court review and creditor objections

The court reviews the filed materials and decides whether to commence the procedure, requesting corrections or examining the debtor where necessary. Once commencement is ordered, creditors are notified and may object to the claim amounts or to the repayment plan. Where objections are raised, we respond with supporting records and amend the plan to the extent required.

  4. 4

    Confirmation, Repayment and Discharge

Three to five years after confirmation

Once the court confirms the repayment plan, the set amount is paid in over three to five years in accordance with it. During that period, individual collection by creditors is absorbed into the plan. When repayment has been completed in full, an application for discharge is made to the court; a discharge order releases the debtor from liability for the debts it covers. Whether discharge is granted is for the court to decide on the facts of the case.

Who this is for

People with ongoing income

Employees, sole proprietors, freelancers, part-timers and day labourers can apply as long as a recurring income is recognised.

Debt within the statutory limits

You can apply if unsecured debt is 500 million won or less and secured debt is 1 billion won or less. If either limit is exceeded, general rehabilitation is considered instead.

Not yet in arrears

Even without any missed payments yet, you can apply if there is a risk of becoming unable to pay.

Frequently asked questions

How long is the wait after filing for individual rehabilitation?

Once the petition is filed the court reviews the papers and decides whether to commence, examines the claims, and then confirms the repayment plan. How long that takes depends on the court's caseload, how complete the filing is, and how many rounds of correction requests are exchanged, so it cannot be fixed in advance. The three-to-five-year repayment period only begins after confirmation, so the two spans should be counted separately. The more complete the file at the outset, the shorter the first stretch.

Can debt from stock trading or gambling go through individual rehabilitation?

The reason the debt arose does not by itself bar a petition. But if the record suggests assets were concealed, that creditors were to be harmed, or that the petition is not made in good faith, the court may decline to commence the procedure. That is why, where investment losses or gambling are involved, it matters to document when money moved, how much, and where it went. Disclosing and explaining is safer than leaving it out.

Can I use a credit card or borrow while the procedure runs?

Credit cards are usually suspended in the course of default and commencement, so continuing to use them is not realistic. Taking out new loans is not advisable either. Debt incurred while the repayment plan is being performed is not adjusted by this procedure and simply remains, and if new borrowing makes the monthly payment unaffordable, the procedure itself is put at risk. If a need for a large sum arises mid-course, tell us before acting.

What happens if I can no longer keep up the payments?

If payments fall behind, the procedure can be discontinued. Where circumstances have changed since the plan was drawn up, income has dropped, dependants have changed, an application to modify the plan can adjust the amount or the term. There is also a statutory route by which the court may grant discharge even though repayment was not completed, where the requirements are met. Either way, the sooner you raise it, the more options remain.

The court sent a correction request, does that mean dismissal?

A correction request means the court wants to check something further; it is not a dismissal. Common subjects are parts of the income or asset history that need more explanation, or discrepancies between the schedule of creditors and the actual debts. That said, failing to answer within the stated deadline can lead to dismissal or discontinuance, so contact us as soon as one arrives. We start by reading through what is being asked and why.

Will my employer be told that I filed?

There is no procedure by which the court notifies your employer that you have filed. If the employer is itself a creditor, an advance or a loan, it is notified like any other creditor. Where wages are already being garnished and the employer therefore knows, court documents may reach the company in the course of stopping the garnishment. Proof of income requires employment records, but obtaining them does not in itself reveal why.

If I am discharged, what happens to my guarantor?

A discharge in rehabilitation or bankruptcy does not extinguish a guarantor's liability. The creditor can pursue the guarantor for the balance, and a guarantor who pays acquires a right of recourse against the debtor. Where a family member or acquaintance has guaranteed a debt, it is better to speak with them before the procedure starts. We flag the guaranteed portions separately at the consultation.

Do I have to appear in court myself?

Most of the procedure runs on paper, but where the court examines the debtor or holds a creditors' meeting, there are hearings you must attend in person. Practice differs from court to court and even between cases in the same court, so once we are instructed we advise you according to that court's approach. When an attendance date is set, we go through what will be asked and how to answer beforehand.

Before you proceed

Debts that are not discharged

Some claims set by law, such as taxes, fines and child support, are excluded from discharge. Check first which debts will remain.

List every creditor

Every known debt must go on the creditor list, and no creditor can be left out.

New debt and arrears during repayment

Debt taken on during the repayment period is not adjusted, and missed payments can lead to the case being dismissed.
