Signal-violation U-turn crash: a fine instead of prison
In a crash where two people were injured during an illegal U-turn at an intersection, the victims' wish not to see our client punished was reflected and a fine was imposed.
How the case unfolded
Background
While making a U-turn at a signalized intersection, our client collided with a car going straight from the opposite direction, injuring the other driver and a passenger in our client's car. Because it involved a signal violation, comprehensive insurance alone did not exempt our client from prosecution.
Issues and ruling
The court found the signal-violation negligence clear, but took into account that both victims did not wish our client to be punished, that our client had made a court deposit for a victim, and that the comprehensive insurance was expected to cover much of the damage.
Outcome
Our client was fined 5 million won, and a victim's application for a compensation order was dismissed.
This is the outcome of an individual case and does not guarantee the same result in similar matters. Some facts have been generalized to protect the parties involved.
