Housing co-op refund: about 56% of the claim granted
Members who lost eligibility in a local housing co-op recovered about KRW 30.24 million, 90% of their contributions, from the company that had assumed the co-op's debts.
How the case unfolded
Background
Our clients joined a local housing co-op and paid fees and contributions, but did not meet the homelessness requirement and were therefore ineligible. After the co-op was dissolved, they sued the company that had assumed all of its debts for about KRW 53.6 million in total.
Issues and ruling
The court held that since our clients had lost eligibility and consented to the debt assumption, the company had to pay refunds under the membership contracts and bylaws. However, the administrative fees were non-refundable, and only the contributions less 10% could be recovered.
Outcome
The company was ordered to pay about KRW 30.24 million of the KRW 53.6 million claimed (about 56%) with interest, and to bear three-fifths of the costs.
