Drunk driving rear-end collision: suspended sentence
After a drunk driving rear-end collision that injured the other driver, our client received a suspended sentence and avoided actual imprisonment.
How the case unfolded
Background
While driving under the influence, our client crashed into a car stopped ahead, and its driver was injured. The collision was serious enough to badly damage our client's car, and our client was charged with drunk driving and causing injury under the Act on Special Cases Concerning the Settlement of Traffic Accidents.
Issues and ruling
The court treated the scale of the accident as an aggravating factor. However, it also considered that, although no settlement was reached, our client had comprehensive insurance and deposited 5 million won with the court for the victim before sentencing, and that the injury was relatively minor.
Outcome
The court imposed one year of imprisonment suspended for two years, so our client avoided actual imprisonment. A 40-hour law-abiding driving course was also ordered.
This is the outcome of an individual case and does not guarantee the same result in similar matters. Some facts have been generalized to protect the parties involved.
