Background
Our client drove about 1 km while drunk and was charged with drunk driving. For the blood alcohol range in question, the law provides for either imprisonment or a fine.
Our approach
We argued for a reduced sentence on the basis of voluntary surrender, pointing to how our client himself had called the police.

The court did not grant a reduction on that ground, but taking into account the circumstances of the stop, the blood alcohol level and other sentencing factors, it chose a fine rather than imprisonment.
