Claim to cancel the State's ownership registration dismissed
An owner claimed that land registered to the State had been split off from the family's forest land and sought cancellation; representing the State, we obtained a dismissal.
How the case unfolded
Background
The opposing party claimed that the land had been split off from forest land it inherited and that the State had registered ownership without any legal basis, and sued our client, the State, to cancel the registration. The State's registration had been in place for more than 30 years.
Issues and ruling
The court found no evidence that the land had been split off from the opposing party's forest land, and, even if it had been, no evidence that the opposing party's predecessors owned that forest land before the split. As ownership on the opposing party's side could not be established, the court did not need to consider the remaining arguments.
Outcome
The claim was dismissed, and the opposing party was ordered to bear the litigation costs.
